of Service for Virtual Hosting.
Delphicomp.com
provides web hosting to people all around the world. We have the responsibility
to protect each client and provide them with the best services available.
The following guidelines were designed to insure these services.
Content:
All services provided by Delphicomp.com may be used for lawful purposes
only. Transmission, storage, or presentation of any information, data
or material in violation of any United States Federal, State or City law
is prohibited. this includes, but is not limited to: copyrighted material,
material we judge to be threatening or obscene, or material protected
by trade secrete and other statue. The subscriber agrees to indemnify
and hold harmless Delphicomp.com from any claims resulting from the use
of the service which damages the subscriber or any other party.
Note: Pornography
and sex related merchandising are prohibited on any Delphicomp.com server.
This includes sites that may infer sexual content, or Link to adult content
elsewhere. This is also true for sites that promote any illegal activity
or content that may be damaging to Delphicomp.com servers or any other
server on the internet. Links to such materials are also prohibited.
Examples of non acceptable
content or links are (but not limited to):
- Pirated software
- Hackers programs
or archives
- Warez Sites
- Adult Sites
- Unauthorized use
of MP3's
- Bulk E-mail programs
Delphicomp.com will be
the sole arbiter as to what constitutes a violation of this provision.
IRC
We currently do not allow IRC or IRC bots to be operated on our servers.
Commercial
Advertising - Email:
Spamming, or the sending of unsolicited email, from a Delphicomp.com server
or using an email address that is maintained on a Delphicomp.com machine
is STRICTLY prohibited. Delphicomp.com will be the sole arbiter as to
what constitutes a violation of this provision.
Server
abuse:
Any attempts to undermine or cause harm to a Delphicomp.com server or
customer of Delphicomp.com is strictly prohibited.
Any Sub Networks
of Delphicomp.com must adhere to the above policies.
Liability:
Delphicomp.com is in no way responsible for down time either resulting
from a users actions, or natural fluctuations in internet consistency.
Delphicomp.com will however, do everything within it's power to assure
that each and every client site is up as consistently as possible.
Refunds:
With the exception of plans including 30 days money back, refunds will
be posted for FULL months only. Notice of cancellation must be given before
the month in question begins. $14.95 will be deducted from the money refunded
if the users domain was registered via Delphicomp.com's free domain registration
period. All refunds are void if any part of the TOS is violated.
Background
Processes:
There will be no unauthorized background processes.
Any will result in immediate termination of account without prior notification.

Uptime Guarantee:
The uptime guarantee pertains to network
uptime only. It does NOT apply to any of the services on the server,
or the server itself.
Fair
Use of Resources:
Sites staying within the transfer limitations
may still be subject to suspension if using more than 15% of total system
resources. The average server houses a minimum of 200 sites with no substantial
load, making this a very fair number.
Account
Setup and charging:
Regardless
of account setup date, the account will be charged once per month on the 1st day of the month. If this day falls on a weekend/holiday, the billing will take place on the next regular business day.
Domain
Transfer Relevancy:
Domain transfer is the sole responsibility
of the customer. The customer will not receive a refund for domains
not being transferred as this is not the responsibility of Delphicomp.com,
but that of the account holder.
Check
Orders:
Accounts which wish to
be setup by check will only be setup when the check is received by Delphicomp.com
Disabling
of accounts due to overdue payment:
When lack of payment reaches
15 days after notice of overdue payment, accounts are disabled.
Termination
of accounts due to overdue payment:
When lack of payments reaches 30 days after notice of overdue payment, account will be terminated
and all information will be deleted from the machine.
Courtesy
services for customers:
All services such as backup and
cpanel are provided for courtesy for the customer. It is the sole
responsibility of the customer, however, to maintain their own backup
of the site. Delphicomp.com is not responsible for loss information for
hosted sites or for bugs via outside programmers from Delphicomp.com.
Terms
Of Service are subject to change without any prior notification
Terms
Of Service is equal to Contract
By
opening an account the individual(s) responsible for the site agree
to all of the Terms and Conditions without question.
Anything
not listed in the Terms of Service is open to interpretation and change
by Delphicomp.com administrators without prior notification
Recovery
of damages will in no way exceed amount of fees collected
All
prices, with the exception of the 30 day money back guarantee, are non-refundable
and non-negotiable.
If
any terms or conditions are failed to be followed it will result in
grounds for account deactivation
without prior notification required.
